A pharmaceutical company will be required to pay $3.7 million to the federal government to help kick-start the erectile-dysfunction treatment Viagra, a federal court has ruled.
In a case that could have a devastating impact on the U. S. health care system, Viagra maker Eli Lilly has agreed to pay $1.5 million to resolve allegations it illegally marketed and sold counterfeit versions of Viagra to the federal government.
The federal judge in San Diego ruled against Lilly in September and ordered the company to pay $1.2 million to resolve the claims.
Lilly had filed suit in federal court claiming the company was responsible for the illegal marketing of Viagra. It also claimed the Viagra product did not contain the active ingredient sildenafil, a chemical used in erectile dysfunction treatments such as Levitra.
Judge Richard W. Burger said the case was "particularly concerning" because Pfizer's patent on Viagra expired in June, giving the drug company a six-month deadline to produce evidence that the drug contained sildenafil.
The judge's decision has sparked a nationalesity wave that is already being amplified by the decision in a number of cases involving counterfeiters and pharmaceutical products.
According to the FDA, counterfeiters produce up to 10 percent of U. sales of Viagra and are known to be selling unsafe drugs.
The Viagra maker has not disclosed any of its sales data to the public because the FDA has not approved it.
The case, filed in the U. District Court for the Eastern District of Virginia, has been brought to trial in more than 20 other federal courts across the country.
In November, the U. Judicial Panel on Multidistrict Litigation announced it was joining a number of other jurisdictions to fight the federal judge's ruling. It ordered the pharmaceutical company to pay $1.2 million to resolve the Viagra case.
"This case is particularly concerning because it demonstrates the importance of protecting our patients and the public from potentially dangerous drugs," said James C. Stahl, Jr., an assistant medical adviser at Eli Lilly, and the firm's senior vice president of research and development.
Viagra has been the subject of several investigations by the Food and Drug Administration since its patent expired and the drug was marketed illegally, and some have been prosecuted and punished by prosecutors for their involvement.
The suit alleged Lilly intentionally marketed Viagra to the federal government's pharmaceutical industry without seeking disclosure of sales data to the court, and illegally marketed the drug to the government's pharmaceutical industry.

The judge found the Viagra manufacturer, Eli Lilly, had not disclosed sales data on its sales of the drug to the federal government, and it had only made that disclosure when it was seeking a ruling from the district court.
Lilly spokeswoman Mary Lou Hirsch said the company "has no plans to vigorously challenge this judgment."
"We will continue to vigorously challenge the decision in the court of appeals," Hirsch said.

The FDA is expected to appeal the judge's ruling, which is set for April 15. The case was settled out of court in a $3.7 million settlement reached in 2015 in the medical malpractice litigation over Viagra.
